***Pension Litigation-Update*** Below is from the Fire Officers pension attorney, Mr. Robert Klausner: On April 26, 2018 the Judge in the pension litigation heard arguments on certification of the class. In a class action, the court has to decide that the case is appropriate for trial based on representative plaintiffs. Although the Court has not yet issued an order, all appeared to agree that determination of liability is proper as a class and the remaining liability issues for the active members will be tried in mid-August. Judge Rubin is conducting further inquiry of the lawyers in a phone conference on May 2nd on the best procedure for hearing evidence on damages for the retirees. The Judge previously held that the city violated its contract with retired and retirement eligible members in two earlier rulings. The parties are also conducting discovery, which is the exchange of documents and the deposition of expert witnesses.
