    ***PENSION RULING UPDATE***

    May 13, 2019

    All:
The following preliminary information, from our attorneys, was received this morning. More will follow once they have had the opportunity to fully examine and review Judge Rubin’s ruling.

“We just received the attached Memorandum Opinion and related Orders from Judge Rubin. The Judge found that the retirees and retirement eligible members are entitled to the post-retirement benefits that were taken away through the elimination of the Variable Benefit. She ruled that the active members are not entitled to the benefits eliminated by 10-306. The Judge certified a class.

Due to the length of the Memorandum Opinion, we have not yet had an opportunity to fully evaluate the Court’s rulings, but we wanted to circulate these materials ASAP. Once we have more fully assessed the decisions, we will report back.”

At this rate, all our BROTHERS are dying off,and we will probably owe the City Money, when we get a ruling.

Thank you for the update. The rag paper had an OK summary of the ruling. Devil in the details. So, we have about a year and a half to go from what was spoken about earlier with the appeal process.

Court ordered or not. I think the city has no intention of paying retiree’s a dime. They’ll find a way to shaft us and there will not be a thing we can do about it. Just a thought
