***Pension Litigation-Update***
Below is from the Fire Officers pension attorney, Mr. Robert Klausner:
Following a pre-trial scheduling conference, both sides have filed motions to exclude part of each other’s expert testimony. These motions are largely technical issues but do center around whether the City’s claimed financial problems in 2010 have anything to do with the issues for trial. We say they do not because when the City breached its contract, it must answer in damages. Those motions will be heard on September 27. In advance of the trial, the Judge has asked each side to file a memorandum of law outlining the issues she should consider. We are well along in that process and they are due to be filed on October 5th. The trial will commence at 9 AM on October 29, 2018 and continue until completed. When filed, the memo of law will be available on the Local 964 website.
